Finally Justice in America! Judge Issues Permanent Injunction Banning California’s Unconstitutional COVID Orders

California Governor Gavin Newsom, like many liberal leaders, has decided to use the COVID-19 pandemic to his favor. He’s far from the only one to behave in such a manner but he might be the most egregious. Newsom is enjoying all of this. It gives him a chance to impose some of the most draconian measures possible, under the guise of keeping the general public safe.

He’s a grifter of the highest order. This tyrant does not care about the legality of his executive orders, either. The state’s legislature didn’t seem to agree with him on much of this but that did not stop him. He’s passed a whopping 57 executive orders since the pandemic began. California residents have not been able to move freely because they are being blocked by his heavy-handed rulings.

California state lawmaker Kevin Kiley finally decided to take action, filing a lawsuit against Newsom. A Northern California county judge also provided a nine-page ruling against him. He was harshly rebuked by both. At long last, California residents are getting the justice that they truly deserve. Kiley even shared the good news with his Twitter followers.

“The Judge has ruled in our case against Gavin Newsom. We won. The Judge found good cause to issue a permanent injunction restraining the Governor from issuing further unconstitutional orders,” he said. Sutter County Superior Court Judge Sarah Heckman issued the ruling about his overstepping of the proper boundaries.

He has no respect for authority and is finally being taught a lesson. The ruling that was handed down is designed to keep Newsom “from exercising any power under the California Emergency Services Act which amends, alters, or changes existing statutory law or makes new statutory law or legislative policy.”

The judge’s orders are clear. Newsom has to stop issuing these orders and passing them off as some form of COVID-19 assistance. Maybe this will show him that these types of rulings are better off being made in a more collaborative manner. Instead, Newsom and his sycophants are willing to do whatever it takes to impose the measures that they think are best without having to talk to anyone else.

There are a few i’s to dot and a few t’s to cross first. “Heckman’s decision will become final in 10 days unless Newsom’s attorneys can raise new challenges. Newsom did not immediately comment or say if he will appeal. The case centers on a single Newsom executive order in June requiring election officials to establish hundreds of locations statewide where voters can cast ballots in the November election.

But lawmakers subsequently approved the same requirement, and the judge’s decision will have no effect on Tuesday’s election. “She acted in a lawsuit brought by Republican Assemblymen James Gallagher and Kevin Kiley, who said Newsom, a Democrat, was single-handedly overriding state laws in the name of keeping Californians safe,” reads the KUSI report.

“This is a victory for separation of powers,” the lawmakers said in a joint statement. Newsom “has continued to create and change state law without public input and without the deliberative process provided by the Legislature.”

Heckman wrote in a nine-page decision that the California Emergency Services Act “does not permit the Governor to amend statutes or make new statutes. The Governor does not have the power or authority to assume the Legislature’s role of creating legislative policy and enactments,” the statement concludes. Newsom and his fellow Democrats are not going to have very much wiggle room here.

They need to stop using the pandemic as an excuse to start passing measures that only make sense to them.
